DailyCheck Terms of Use and Disclaimer

Version date: 12 October 2026 Version ID (repo): 2026-10-terms-v3

These Terms describe DailyCheck's scope of service, the rules for using it, the limits of its artificial intelligence and notification features, data processing, security risks, and how responsibility is allocated. Please read them before registering, and pay particular attention to sections 3 to 8 and sections 12 and 24 to 26. You may save these Terms and read them again at any time while using the service.

1 Scope and relationship between documents

"DailyCheck", "we" and "us" mean the operator referred to above; "you" means a person who uses the service. The "service" includes the DailyCheck application, website, AI conversations, daily check-ins, reminders, notifications to family members or caregivers, related content, and any other features actually provided.

These Terms apply to individual users. Where an organisation, pilot, research collaboration or other special service is covered by a separate written agreement, that agreement applies to the extent it expressly provides. A feature that has not been launched does not become a service commitment merely because these Terms mention it.

The Privacy Policy explains how personal information is handled; a separate research consent form applies only to research in which a user voluntarily takes part. The specific handling of personal information is governed by the Privacy Policy and any relevant valid consent, and is always subject to applicable law. These Terms do not constitute an unlimited licence over data.

2 Accepting these Terms and valid consent

When you register, you must actively confirm that you have read and accept these Terms. If you do not understand any part, please ask for an explanation first; you may decline and not register, or stop using the service and request deletion of your account as these Terms provide.

A user's continued use of the service must not, by itself, be treated as giving all the consent needed for a new non-essential use of data, additional research, or a significant privacy change. Where applicable law requires it, we will obtain valid consent separately.

3 Nature of the service; no professional services

DailyCheck provides AI daily companionship, general everyday interaction and related communication tools. It is not a medical service provider, a licensed healthcare professional, a medical device, a treatment service, or an emergency rescue service.

The service does not provide diagnosis, treatment, prescriptions, clinical assessment, or medication or dosage advice, and it does not provide medical, legal, financial, insurance or other professional advice. Even where content mentions health, emotions, exercise, nutrition or lifestyle habits, it should not be regarded as a personalised professional assessment or treatment plan.

You should not start, stop or change any treatment, medication or professional care arrangement based on content from the service. Such decisions should be discussed with a qualified professional. The service does not guarantee any improvement in loneliness, mood, illness, cognitive ability, health or any other personal condition.

4 Emergencies; no continuous monitoring

DailyCheck is not an emergency monitoring, crisis intervention, personal safety monitoring, or rescue dispatch system. We do not undertake to monitor conversations continuously, to confirm the identity of a real person, or to detect falls, self-harm, harm to others, loss of contact, abuse, worsening illness or any other danger, nor do we undertake to report immediately or to dispatch anyone.

The AI may fail to understand an emergency message and may produce inappropriate replies. Even if the system gives a prompt, a link to resources, or a suggestion to contact someone, this does not mean that a risk assessment has been carried out, that emergency services have been contacted, or that any intervention has been arranged.

If there is an emergency or danger, use the appropriate emergency channels directly. Do not wait for a reply, reminder or notification from DailyCheck.

5 AI output and reliability of information

AI conversations, reminders, summaries, translations, recommendations and other outputs may be wrong, incomplete, out of date, biased, misleading, inappropriate, inconsistent, fabricated or illogical. The AI may misunderstand tone, dialect, identity, time, context and personal circumstances, and may record, omit or cite earlier information incorrectly.

Speech recognition and translation may introduce further errors. A confident tone, repeated replies or content that seems personalised does not mean the content has been verified, supervised by a person, or professionally qualified. Where the AI says that something has been remembered, notified or done, this should not be treated as proof, based on the conversation text alone, that the system actually performed that action.

You should verify important information and should not use AI output as the sole basis for health, safety, legal, financial or other important decisions. We do not guarantee that output is correct or original, fit for a particular purpose, or free from infringement of third-party rights; actual use remains subject to sections 24 to 26 and applicable law.

6 AI identity and human interaction

The AI is not a real person. It does not have human emotions, consciousness, professional judgment or caregiving ability. Warm, caring or human-like expressions are system-generated content; they do not represent a promise by a real person, a professional relationship, or any actual duty of care.

The service does not replace family, friends, caregivers, community support or professional services. Users should maintain suitable contact with real people and suitable care arrangements. If the AI mentions a person, organisation, product or resource, this does not mean that we have verified or guarantee its identity, qualifications, quality or safety.

7 Daily check-ins and status records

Check-in and usage records reflect actions or signals received by the system. They are not proof of the user's physical health, safety, alertness or location, or of whether the user is in danger. An account may be operated by someone else; automation, synchronisation errors, time-zone settings or network delays may also affect the records.

A completed check-in, a conversation record, a "normal" status or the absence of an alert does not mean there is no risk. A missed check-in does not necessarily mean that an incident has happened. Family members and caregivers should check the situation themselves and must not use what the system shows as a substitute for direct contact or suitable care arrangements.

8 Limits of notifications and contacts

Reminders, push notifications, emails, SMS and other notifications may be delayed, duplicated, missed, fail to deliver, be blocked, go to spam, reach the wrong contact, or not be sent at all because of settings or service faults.

You should provide accurate contact details that you are properly authorised to provide, keep your details and notification settings up to date, and confirm that the designated contacts are willing to receive the relevant notifications. A device being switched off, power-saving mode, permission settings, silent mode, and carrier or platform restrictions may all affect notifications.

We do not guarantee that a notification will be received, read, understood, acknowledged or followed up, nor that any contact is able or willing to help. A notification is not emergency rescue; please make separate arrangements for direct contact and any necessary backup measures.

9 Eligibility and acting for others

You must have the legal capacity to accept these Terms and give the required consents, and must meet the age and other eligibility requirements clearly stated at registration. You should provide accurate information and must not impersonate anyone.

If you help another person register, manage their account or set up notifications, you must have valid authority to do so. Being a family member, caregiver or organisation does not by itself give the right to consent on the user's behalf, view their conversations or receive all of their personal information. For a person who cannot validly consent for themselves, appropriate authority and consent arrangements must be put in place in accordance with applicable law.

10 Account and device security

You should keep your password, verification codes and login details safe, not share them with anyone who is not authorised, and take reasonable steps to protect your device. Log out when using a shared device; if you notice a suspicious login, account theft, a lost device or an unauthorised change to settings, please tell us as soon as possible.

Do not give your account password, one-time verification codes, full payment card details or other highly sensitive information unrelated to the service in a conversation.

To the extent permitted by law, we are not liable for losses caused by a user's failure to take reasonable security measures; this does not shift to users any responsibility for our own security failures, unlawful processing, or liability that we bear under law.

11 Acceptable use and prohibited conduct

You must not use the service for fraud, impersonation, harassment, threats, discrimination, infringement, illegal activity, unauthorised disclosure of personal information, or to spread malware, spam or other harmful content.

You must not access other accounts without authorisation, bypass verification or security restrictions, interfere with the systems, carry out denial-of-service attacks, scrape non-public data in bulk, or exploit vulnerabilities to obtain data or permissions. Activities expressly permitted by law and testing approved in writing are not subject to restrictions beyond what the law permits.

We may take appropriate measures to limit interactions, remove content that breaches these Terms, suspend accounts or take action in accordance with law. However, we do not guarantee that we can identify or stop all content that breaches these Terms or is dangerous or offensive; ordinary requests for help or expressions of dissatisfaction should not be treated as breaches merely because they cause discomfort.

12 Risks of cyberattacks and data breaches

Even with reasonable security measures in place, the service may still be affected by hacking, ransomware, malware, phishing, social engineering, credential theft, denial-of-service attacks, supply-chain incidents, third-party vulnerabilities, unauthorised internal access or other security incidents.

Such incidents may lead to account theft, service interruption, incorrect notifications, or data being accessed, copied, disclosed, modified, deleted, encrypted, lost or used unlawfully, and may cause identity misuse, fraud, financial loss, reputational harm or emotional distress. We do not guarantee that the service will never be attacked, that all data breaches can be prevented, or that all data can be recovered.

To the extent permitted by applicable law, losses arising from such incidents are subject to the limitations of liability and exceptions in sections 24 to 26. The mere occurrence of a security incident does not mean that we automatically bear all losses; equally, merely calling an incident a hacking attack, a third-party incident or force majeure does not automatically release us from our legal obligations or from liability we bear under law.

We will fulfil our obligations under applicable law regarding reasonable safeguards, incident assessment, record-keeping, reporting and notification. Nothing in these Terms excludes any security, privacy or data-breach liability that cannot be excluded by law.

13 Privacy and limits of confidentiality

We handle personal information in accordance with the Privacy Policy and applicable law, and take reasonable security measures proportionate to the sensitivity of the information and the risks. No method of electronic communication or storage can guarantee absolute security.

Conversations with the AI do not create a doctor–patient relationship, a lawyer–client relationship, or any corresponding legal professional privilege. This does not affect our duties of confidentiality and protection in respect of personal information.

What information a designated contact can obtain should be determined by the actual features, permission settings and valid consent; it must not be assumed that a person can view all conversations merely because they are listed as a contact. The scope of human review, security logs, customer-support access and third-party processing must be described truthfully in the Privacy Policy.

14 Use of data; no sale of data

Within the scope set out in the Privacy Policy and any valid consent, we may process account information, content provided by users, check-in records, preferences, and device and usage records in order to provide and maintain the service, personalise interactions, protect security, handle support, analyse faults and improve DailyCheck.

Research and analysis uses should be limited to clearly disclosed purposes of improving the DailyCheck service, quality assessment and related research; necessary uses such as legally required retention, handling complaints and compliance must also be disclosed truthfully. "Improving the service" must not be used as a blanket authorisation for undisclosed uses.

DailyCheck does not sell users' personal information, conversation records or usage records to third parties, and does not use the sale of such user data, or of research data derived from it, as a source of revenue. Permitting service providers to process data in order to help provide the service is not a sale of data, but it must still comply with legal, policy and contractual restrictions.

15 Research and non-essential model training

Within the scope of the law and of what has been disclosed, we may use data that has been appropriately de-identified or aggregated for product improvement, internal research and statistical analysis. De-identification should not be described as carrying no risk of re-identification at all; where data can still reasonably identify an individual, it must still be handled under the applicable privacy rules.

Using identifiable data for non-essential research, external research collaborations, research publication, or model training that is not necessary to provide the service should be preceded by a separate explanation of the purpose, scope of data, recipients, risks and how to opt out, and, where the law requires, by separate, voluntary and specific consent.

Refusing non-essential research or non-essential model training does not affect the basic service. Research reports should not disclose identifiable conversations or cases unless there is a separate valid specific consent and a lawful basis. Third-party providers must not obtain, on the strength of these Terms alone, a blanket authorisation to train models for their own purposes.

16 Third-party providers and cross-border processing

The service may rely on cloud, AI, communications, analytics, payment, app-store and other third-party providers. Their failures, limitations, vulnerabilities, policy changes or discontinuation may affect DailyCheck.

For providers we engage to process personal information, we must still meet our applicable responsibilities for selection, contractual restrictions, reasonable oversight and protection, and cannot disclaim all responsibility merely because a third party is used.

If data is processed outside Canada, the Privacy Policy must clearly explain the arrangements and risks. Data may be subject to local laws and to lawful access by governments there. The actual processing locations, providers and purposes should be disclosed truthfully; these Terms do not guarantee that all data is stored only in Canada.

17 External links and third-party conduct

The service may provide links to external websites, resources, products, community information or third-party services. Unless expressly stated otherwise, that content is not operated by us; a link or mention is not a recommendation, endorsement or guarantee.

You should verify the third party's identity, qualifications, terms, charges and safety yourself. Fraud, harassment, breach of contract, incorrect content or misconduct by a third party does not automatically become our responsibility because the service provided a link; our own conduct, and the liability we bear under law, remain subject to applicable law.

18 Data retention and account deletion

Data retention periods and deletion procedures follow the Privacy Policy. We do not promise to keep data indefinitely, provide permanent backups, restore all records, or immediately erase all backups. The service is not a formal medical record, a safekeeping system for important documents, or a system for preserving legal evidence.

You may, in accordance with law, request access, correction, withdrawal of consent or deletion; withdrawing consent to necessary processing may affect related features. Necessary legal, security and dispute-handling records and backups may be kept for the disclosed periods, to the extent permitted by law.

Data that has been genuinely anonymised and cannot reasonably be linked to you, or aggregated research results that have been lawfully published, may not be deletable by individual account; identifiable data must not be kept under the label of de-identification in order to avoid users' rights.

19 User content and intellectual property

You keep the rights you have under law in the content you provide. Using the service does not transfer general ownership of your personal information to DailyCheck. You must have the right to provide the content and any third-party information.

You grant us a limited, non-exclusive licence, to the extent necessary, to store, process, transmit and display that content for the disclosed service purposes and in accordance with valid consent; this licence does not cover unauthorised sale, making your private conversations public, or unrestricted research use.

DailyCheck's software, brand and proprietary materials remain the property of us or the relevant rights holders. AI output may resemble content obtained by others; we do not guarantee its uniqueness, eligibility for copyright, or that it may be freely used commercially. No content licence replaces the requirements of privacy law and valid consent.

20 Device compatibility and cost of use

You must have a suitable device, network connection and the necessary permissions. Device performance, operating-system version, storage space, browser, security settings, and carrier and third-party platform restrictions may all affect the service.

We do not guarantee that the service works with every device, version or assistive technology, but this section does not exclude applicable accessibility or other statutory obligations. Unless expressly arranged otherwise, network, data, SMS and device charges are borne by the user under their contract with their provider.

21 Paid and subscription features

If paid services are offered, before purchase we will set out the price, currency, taxes, billing cycle, automatic renewal, charges after any trial period ends, how to cancel, and the refund rules. No charge may be made without valid authorisation.

Payments may be processed by a third party or an app store, whose transaction rules may apply. Cancelling a subscription does not necessarily mean deleting the account; deleting the account should not, without a clear explanation, be treated as having cancelled all third-party subscriptions.

All refund and termination arrangements are subject to applicable consumer rights. Prepaid services that are not provided, that materially fail to match what was promised, or that cannot be used because we terminated them, must be handled in accordance with applicable law and the disclosed rules. These Terms are not a statement that no payments are refundable.

22 Test features and changes to the service

Features labelled as pilot, test, preview or experimental may be incomplete or less stable, may produce errors, or may be removed after testing. Test status does not exempt us from protecting personal information or from other statutory obligations.

We may modify, restrict or discontinue features for security, legal, technical, maintenance, supplier or operational reasons. We will give advance notice of significant changes where reasonably practicable and where required by law; where additional consent is needed, we will obtain it separately.

We do not guarantee that any particular feature, free plan, history-record format or third-party integration will exist permanently, and future features mentioned in promotion are not commitments about the current service.

23 Suspension and termination of the service

We may suspend, restrict or terminate an account or the service because of a serious breach, fraud, security risk, illegal conduct, a legal requirement, or cessation of operations. Immediate action may be needed to deal with urgent security or legal issues; in other cases we will give notice to the extent reasonably practicable and required by law.

If you believe your account has been restricted in error, you may request a review through the published channels. We do not promise to handle it immediately or that the account will necessarily be restored, but this does not exclude any rights of complaint and remedy you have under law.

Payment matters, data access, export and deletion after termination are handled according to the actual features, the Privacy Policy and applicable law. Terminating an account cannot by itself extinguish rights that still exist under law.

24 Provided "as is"; matters not guaranteed

To the fullest extent permitted by applicable law, the service is provided as is and as available at the time. Except for binding commitments we expressly make and protections that cannot be excluded by law, we give no express, implied or other warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement and being completely error-free.

We do not guarantee that the service will be continuously available, absolutely secure or completely accurate, free of malicious code, that data will not be lost or altered, that any defect will be fixed, or that the service will meet all personal expectations. Customer-support explanations or AI replies do not, on their own, constitute an unauthorised professional warranty.

These Terms do not revoke binding commitments we made before purchase or registration, do not exempt us from liability for misleading advertising, and do not exclude the quality standards, protections and remedies required by applicable law.

25 Limitation of liability and categories of loss

To the fullest extent permitted by applicable law, and subject to section 26, DailyCheck, its operator and its related directors, employees, agents, licensors and suppliers are not liable for indirect, incidental, special, consequential or punitive losses arising from the use of, or inability to use, the service, including losses relating to profits, revenue, goodwill, business opportunities, anticipated savings, opportunities of use, and data.

Liability that may be limited under law includes claims relating to: AI errors or inappropriate content; misunderstood reminders or status; notifications that are delayed or not followed up; unauthorised use of an account; cyberattacks or data incidents; third-party failures or conduct; data deleted or not recoverable; system interruptions; device incompatibility; feature changes or lawful termination; and decisions made by users based on the content of the service.

To the extent permitted by law and not involving the exceptions in section 26, the above limitations may apply to claims in contract, tort (including ordinary negligence) or on any other legal basis, even if we were told such loss was possible. Whether accidents, injury, emotional distress, identity theft and financial loss can be limited must still be decided according to their nature, cause and applicable law; they are not excluded wholesale merely because they are listed in these Terms.

A cap on total liability may be agreed separately in terms that have been reviewed and clearly disclosed; unless a specific cap has been set out and validly agreed, these Terms do not by themselves create a zero or arbitrary cap on compensation.

26 Liability and rights that are not excluded or limited

Nothing in any exclusion, liability cap, indemnity, user-responsibility, force-majeure or termination provision of these Terms excludes or limits any liability, obligation or right that cannot be excluded or limited by law.

Nor do these Terms use any exclusion to shield our fraud, wilful misconduct or gross negligence, shift to users our responsibility to protect personal information, or limit the power of regulators to investigate or enforce in accordance with law.

The consumer, privacy, complaint, refund and other remedial rights you have under law remain in effect where applicable. Any exclusion or limitation that applicable law does not allow applies only to the extent it is lawful.

27 User breaches and third-party claims

To the extent permitted by applicable law, if a third-party claim is caused directly by your intentional or material breach of these Terms, unlawful use, fraud, or disclosure of third-party information knowing that you were not authorised to do so, you may be required to bear the reasonable losses and handling costs actually caused by that conduct.

This arrangement does not apply to any part caused by the fault, unlawful conduct or breach of these Terms by us or by the related protected persons. We should give you reasonable notice of the relevant claim and a reasonable opportunity to take part and defend, and must not, without your consent, accept a settlement that places additional obligations on you.

Normal use of the service, making a complaint, lawfully exercising privacy rights, or not following AI suggestions is not a reason for you to compensate us.

28 Force majeure and events beyond reasonable control

Natural disasters, power outages, major telecommunications outages, war, public emergencies, government measures or other events beyond reasonable control may affect performance of the service. To the extent permitted by law, liability for non-performance caused by such events may be correspondingly limited.

We must still take reasonably practicable steps in response and fulfil obligations that cannot be excluded by law. Not every cyberattack, supplier failure, lack of funds or ordinary technical problem automatically counts as force majeure; whether it applies must be decided on the actual circumstances and the law.

29 Notices and updates to these Terms

We may give service and legal notices through the application, the website, email or other suitable channels. A record that a notice was sent does not necessarily prove that the user has read it or has validly consented.

When we update these Terms, we will state the version and effective date, and give notice of significant changes where required by law and where reasonably practicable. For matters that require fresh consent, we will not substitute "continued use means acceptance" for the consent required.

New limitations of liability do not apply retroactively to incidents that occurred, or rights that arose, before they took effect, unless applicable law permits it and there is a separate valid agreement.

30 Complaints and dispute resolution

You may make complaints about the service, security, privacy or charges through the published contact channels. We encourage you to contact us directly first, but completing our internal process is not a precondition for exercising your statutory rights.

If a matter cannot be resolved, you may use the applicable courts, regulators and procedures available under law. These Terms do not require you to give up court proceedings, class actions, regulatory complaints or other rights that cannot be waived under law. After a dispute arises, the parties may voluntarily agree to mediation or another procedure permitted by law.

31 Governing law and general terms

Without depriving you of any mandatory protections and jurisdiction that apply under law, these Terms are interpreted in accordance with the laws of the Province of Ontario, Canada and the applicable federal laws of Canada; a court with jurisdiction may hear related disputes.

If one provision is invalid or unenforceable, this does not necessarily make other provisions that can lawfully be severed invalid. Not exercising a right immediately does not mean the right is waived. Provisions concerning data, intellectual property, payments already incurred, liability and disputes may continue to apply after termination, to the extent their nature and the law allow.

These Terms and the documents expressly incorporated into them form the relevant service agreement, but do not remove any representations or protections on which users can rely under law. Where a business transfer, merger or asset transaction involves personal information, it must still comply with applicable law and the Privacy Policy; transferring the service does not authorise any sale of data contrary to these Terms.

If different language versions differ, this is to be dealt with according to applicable law and valid agreements; a rule that the English version prevails, if not clearly disclosed, cannot be used to weaken users' rights.

32 Confirmation of use

The above confirmations must be actively completed before registration. Whether to agree to non-essential research or non-essential model training should be decided through a separately provided optional consent process; it must not be pre-ticked, and refusing those uses must not be a reason for refusing the basic service.
